In our blog posts dated 30 July 2012 and 4 February 2013 we discussed the proposed introduction of Employment Tribunal fees from Summer 2013. It has now been announced by the HM Courts and Tribunal Service that from 29 July 2013, subject to the draft fees order being approved, payment of Tribunal fees will be introduced.
Under the new system, a claimant will be required to pay an issue fee when the claim form is submitted and a hearing fee 4-6 weeks before the final hearing. The level of fee will depend on the type of claim but these have broadly been split into two categories;
• Type A claims such as unlawful deduction of wages, holiday pay and certain breach of contract claims and
• Type B claims such as unfair dismissal, discrimination and whistleblowing.
The issue fee for a type A claim is £160 with a hearing fee of £230 and for a type B claim, an issue fee of £250 and hearing fee of £950.
In addition to issue and hearing fees there will also be fees for certain other applications such as dismissing a claim on withdrawal, review of a judgment or judicial mediation. A similar fee system will also be introduced in the Employment Appeal Tribunal.
